Family seeks $900K in alleged Provincetown drowning

PROVINCETOWN — The family of a Truro man who allegedly drowned in Provincetown Harbor in 2008 is seeking $900,000 from Provincetown for rescuers' failure to resuscitate him and failure by the town to keep the beachfront safe.

Margo Martin, wife of the late Robert J. Martin Sr., a former Truro Board of Selectmen member, notified the town last September that she wanted the money to compensate for his "untimely and wrongful" death. Robert Martin Sr. may have survived if rescuers had made "any attempt whatsoever" to revive him, according to a Sept. 4, 2009, letter from attorney Daniel Solomon of Sandwich. When the police arrived, Martin had not been in the water long enough to have died from drowning, the letter states.

I wish the old Times forums for stuff like this. She has 1/2 clue about local politics and is remembering the "sue the town" part. I hope the judge tosses this out of court and steamrolls her about it. 'Personal Responsibility' I think it's called.

Martin, who was 73 at the time of his death, was a longtime Truro selectman and real estate agent, and an avid hunter and fisherman. After maintaining sobriety for three decades, he had struggled with alcohol abuse in the last few years before his death, according to a former business associate and comments Margo Martin made in 2008.

Among the last people to see Martin alive was shuttle bus driver Albert Robinson of Truro, who saw Martin stumble and fall near Fisherman's Wharf at about 8 p.m., the police report states. Robinson told the police he helped Martin to a bench. He said Martin smelled strongly of alcohol and Martin had said he'd had too much to drink and "just needed some air."

This update has shot a hole in the claim. Seems more like a suicide to me. Tragic way to go. Especially for the family. Money won`t take away the pain they feel. Coming out of denial & time is the only thing that`ll help them now.
